--------------------------------------------------------- ATTENTION - IMPORTANT NOTICE: THIS IS A CONTRACT. BY INSTALLING THIS SOFTWARE YOU ACCEPT ALL THE TERMS AND CONDITIONS OF THIS AGREEMENT. The software and related documentation that you are about to access ("Software", as further defined below) is offered to you (either an individual or a legal entity) by BitCtrl Systems GmbH ("BitCtrl") of Weissenfelser Str. 67, 04229 Leipzig, Germany (voice: 49-341-490670, fax: 49-341-4906715) for use only in accordance with the terms of the BitCtrl End User License Agreement ("EULA") below. Some Software components have supplementary or alternative end user license agreement terms, as noted in below. The term "Software" also shall include any upgrades, modified versions or updates of the Software licensed to you by BitCtrl. Please read carefully the license agreement before installing the software package and respectively before using the software. With the opening of the seal on the package and installing the software and respectively the use of the software you are accepting the following software license agreement from BitCtrl. BY ANSWERING "YES" OR "I AGREE" DURING THE DOWNLOAD OR INSTALLATION OF THE SOFTWARE, OR OTHERWISE ATTEMPTING TO DOWNLOAD, COPY, INSTALL, OR USE ANY PART OF THE SOFTWARE, YOU ARE REPRESENTING THAT YOU HAVE READ AND AGREE TO BE BOUND BY THESE AGREEMENTS. Nothing else grants you permission to COPY, USE OR MODIFY the Software or its derivative works. These actions are prohibited by law if you do not accept these LICENSE AGREEMENT TERMS. DO NOT PROCEED UNLESS YOU ARE ABLE AND WILLING TO ENTER INTO AND COMPLY WITH THESE AGREEMENTS. IF YOU HAVE ANY QUESTIONS CONTACT BitCtrl BEFORE YOU ATTEMPT TO COPY, INSTALL OR USE ANY PART OF THE SOFTWARE. Upon your acceptance of this Agreement, BitCtrl grants to you a nonexclusive license to use the Software, provided that you agree to the following:
License 1. Available agreement guarantee that from the use of the purchased package the legitimate license is free and clear of third party rights, taking into account the rights of patent holders, represented by MPEG LA (www.mpegla.com), whereas BitCtrl has permission to transfer the license of patent holders to the user, based on agreements between BitCtrl and MPEG LA for MPEG-2 Video and Systems, for MPEG-4 Visual and for AVC/H.264. The manufacturer guarantees the executability of the package when it is applied to the equipment described in the technical documentation. 2. The license allows a copy of the software to be installed on distinct, separate computers under the assumption that the software is only used on one single computer under the software and respectively hardware protection each time. The use of the software without the proper protection device is strictly forbidden. The software is valid when it has been "installed" on a computer, when it is loaded into the direct access memory (RAM), or is installed to a solid storage device (disk, CD-ROM, Flash, etc.). 3. It is permitted to make a copy of the software for security purposes. 4. It is permitted to relinquish all rights of this agreement to a third party, as long as at the time of the sale or surrender of the user's rights to the license the entire package is also handed over (including all components, data carriers, printed material, hardware equipment, and the available license agreement, as well as all updates and versions), provided that the third party is completely and without reservation in agreement with this license agreement. 5. Outside of the license agreement and outside the explicitly written authorization by BitCtrl the following is strictly forbidden:
6. You may not use the "Trial" and "Demo" versions of the Software for more then 15 days without explicit permission from BitCtrl. Copyright and Trademark Rights 7. The ownership and creator's rights of the package "bitcontrol(r) MPEG video decoder" and "bitcontrol(r) Digital TV Link" (software, documen- tation, illustrations, user examples, animations, videos, audio, music and text) belongs to the manufacturer "BitCtrl Systems GmbH", Germany, and are protected through copyright law and international copyright agreement, as well as being protected by other laws and agreements for the protection of intellectual property. The software packages are licensed and not sold. Through this license agreement is no ownership rights of any kind transferred to the user. In agreement with the laws of the relevant state and the license agreement purchase of this license is solely for the right to use the package. Use of any trademark does not give you any rights of ownership in that trade- mark. Except as stated above, this Agreement does not grant you any intellec- tual property rights in the Software. 8. bitcontrol® and BitCtrl Systems® are registered trademarks of BitCtrl Systems GmbH, Germany. Scope of Supply 9. The scope of supply exists with the following components: 10. The package is distributed complete. An adjustment of the package for any particular user will not be done. Any adjustment must be done by the user themselves or with help from the manufacturer, or respectively their representative. The manufacturer does not guarantee the realization of an individual adaptation to the package. Guarantee 11. The guarantee period starts the moment of delivery of the package to the user and is valid for a period of 6 months time. 12. All support of the package will only occur after the validation of the original package through the licensing agreement with a valid license number. 13. For the guarantee period the following support can be expected from the manufacturer and their representatives: All listed support does not include the possibility of travelling to the user site. 14.
